Dispute Resolution Appointments
“Construction adjudication has now been a central feature of alternative dispute resolution for over 15 years. What parties want and need in their adjudicators is independence, experience and, increasingly, a good working knowledge of conducting the proceedings in an absolutely fair way. This last quality is important so that both parties – whether successful or unsuccessful – feel that the process has been properly conducted. In that way the chances of final resolution based on the decision are much greater.
As the Judge in charge of the Technology and Construction Court I encourage the use of TECBAR’s Dispute Resolution Appointment process.
TECBAR has recourse to a body of nominees who are specialists in their field of construction law and are very familiar with the principles of dispute resolution. All TECBAR nominated adjudicators are required to undertake training before membership is approved and their independence can be taken for granted.
In addition, the appointment process is not just there for adjudication. It can be used for selection of arbitrators, mediators and DRB members.
Whenever agreement on a named individual is not possible, I am very happy to commend the use of TECBAR as a nominating body for any form of dispute resolution.”
Mr Justice Edwards-Stuart
